          Every year many of our customers wrestle with this issue. Should they lock in before prices rise in the winter? Should they wait and see what prices do in the fall, and perhaps lock in then? Should they pass on the opportunity to enter into a fixed rate contract and hope to “ride the market down?”
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

          At Jamie Oil, we generally avoid making projections about the future of oil prices. We also believe the decision of locking in or not locking in is an issue consumers can best navigate based on their own budgets and other financial considerations that are specific to their situation.           That said, a few noteworthy events are happening in the worldwide oil markets that could influence oil prices for the better as far as consumers are concerned. First, the Organization of Petroleum Exporting Countries (OPEC) has lost their clout. The cause of gasoline shortages in the 1970’s and the bane of Jimmy Carter’s years in Washington, the twelve nation cartel has too much competition to control oil production and prices worldwide. OPEC got greedy and now they are paying for it. The second factor is the strong US dollar. When compared to other currencies, the dollar buys more goods than it did five or seven years ago. Since oil is priced in dollars per barrel in international markets, a strong dollar makes for better purchasing power for American consumers. A strong dollar lowers oil prices everywhere.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Perhaps most significant is the “shale boom” right here in the US. With domestic crude production near four million barrels a day and vast reserves currently available in the US and in Canada, the supply picture has changed. If OPEC seeks to increase prices, look for more North American wells to begin pumping.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Just as real estate, the stock market and interest rates cycle through their ups and downs, it appears that the oil markets have cooled off after a ten year period that saw prices rise to levels never seen before. History teaches us that it is not uncommon to have innovative suppliers who employ technology to pop the balloon of those who once controlled the market. OPEC is no longer in charge. The result is a better value for the consumer. Oil heat is expected to be more financially competitive with other sources of heat over the next five years.

          Below please find ten things you should know prior to making your decision.

           Do not expect to “pick the bottom” of the market.

          None of us are getting any younger, and that goes for your furnaces and boilers also. So that leads us to the question “Is buying a service policy a good idea?” We think so.

    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Jamie Oil offers 3 different levels of service policies to suit your specific needs.  All equipment should be cleaned/tuned up annually so our tune up policy is an easy choice and we offer it to you at a flat, competitive rate. We’ll even send you a reminder notice when it’s due for a cleaning because keeping your system “healthy” with annual maintenance leads to a longer life.

          Even if we take care of ourselves, we can all slip a disc at some point and that is why we offer policies with more coverage. Our standard policy covers the tune up and additionally provides coverage for a long list of parts and the labor to install those parts. With the cost of copper parts rising, one repair will normally pay for the additional cost of the coverage.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

          For those of you with boilers and possibly water on the knee, our deluxe policy provides what the standard policy does but also covers some water parts. Deluxe policies are intended for boilers only as there is no benefit to the consumer who owns a warm-air furnace to purchase deluxe coverage. The deluxe policy will be about $50 more than what a tune up and annual purge for your boiler would cost, so dollar wise it also makes sense.

      <title>What is Downside Protection?</title>

          Downside protection is an option Jamie Oil offers at an additional cost which ensures that your price per gallon will decrease should oil prices fall after you have locked in. If you choose to purchase downside protection when you sign a contract, and our daily posted price is less than the rate you locked in at on the day of your delivery, Jamie Oil will charge your account the lower rate.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

          In July of 2008, oil prices reached a high of $4.799 per gallon, and continued to rise. Many customers feared paying over $5.00 a gallon, so they began to lock in at the $4.799 rate. As the winter approached and the cold weather settled in, prices began to fall. By December, our daily discounted rate dropped to $2.599 per gallon. Customers who locked in during the summer were now paying $2.20 more per gallon than the customers who decided not to lock in, and many customers that requested fixed price contracts wanted to break their contract and get out of the deal.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          As our practice has always been, Jamie Oil only offers fixed price contracts to those who request to lock in. We do not encourage or discourage our customers to sign a contract; it is your decision. We offer all of the options in the marketplace to our customers and we let you decide whether or not to lock in. And in every contract we send, there is the downside protection option which is our insurance program that lessens the financial impact to those who fear locking in at the wrong price.
         &#xD;

      <title>Some things don’t change…</title>

          Some of us remember the oil shortages of the 1970’s. We all have heard about them. I remember waiting in line as gasoline was rationed by stations in our hometown.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          What most people take for granted is the twenty- five year period of relatively inexpensive oil prices that followed the Iranian Revolution and the Arab Oil Embargo.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          When I was growing up, my father heated his home with oil. In 1980 he made the switch to Natural Gas. He was motivated primarily by the projected savings the natural gas utility claimed he would enjoy. He fired his local oil dealer. He invested what amounted to about two months pay, dug up his lawn, installed new heating equipment and incurred unexpected expenses that the utility failed to prepare him for.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          I began working in the oil business in 1982. Every year my dad would ask me (because the gas company’s bills are difficult to read) to figure out for him if he was actually saving money with natural gas. He was very disappointed when he learned that within a year or two of making the switch, home heating oil was, on a BTU equivalent basis, cheaper than natural gas. Heating a home with oil continued to be cheaper than gas for fifteen of the next seventeen years that he lived.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          A few years ago, when oil prices rose to levels never seen before, as they did in the days of Jimmy Carter, natural gas utilities once again dusted off their marketing programs in an effort to attract consumers who were “stuck with expensive oil.” We all know what happened next: Oil prices fell as markets corrected causing those who spent ten to twenty thousand dollars to switch from oil to natural gas to feel like fools and suckers. Some things do not change.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          My dad had a friend in our neighborhood who was a landlord. He was very smart. We will call him “Billy”. Billy wisely bought a lot of property in the sixties, seventies and eighties. My dad told me how Billy borrowed money off his life insurance policy at 2% and reinvested it in a secure money market account at 18% (you could do that back then). Billy was, “Shrewd. He knows what is going on…always did”, my dad would say.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          When I was in high school Billy bought the most prominent commercial building in our town. Almost twenty years ago, when Billy learned that I owned Jamie Oil, he asked me about putting the commercial property on automatic delivery. He negotiated hard, he knew all about BTUs, therms and kilowatt hours. He knew the value of each. Then about twelve years later, when natural gas was once again cheaper than oil for a few months, Billy told me “Switching to gas simply does not pay, you just can’t amortize or recover the expense, especially when you add in the hidden costs. It rarely pays to panic.”
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          My dad was right. Billy knew what was going on and he still does. We delivered oil to his building last week.
          &#xD;
      &lt;span&gt;&#xD;

  &lt;/p&gt;&#xD;

      <title>And then it snowed….</title>

          In the heating oil business, January 21st marks the mid point of our season. At that point this past winter, we were having a slightly warmer than normal heating season and everybody was talking about the Super Bowl bound New England Patriots. Nobody was talking about the weather.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Then everything changed. In late January it became very cold outside and then it snowed. It then got colder and it snowed again, and again. It seemed as if two out of three Metrowest homeowners had ice dams, and it still continued to snow. The month of February was the coldest we have had in over twenty five years. The month of March came in like a lion and pretty much roared until opening day at Fenway Park.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The extreme cold and record snowfall caused home heating oil suppliers to encounter very challenging conditions this past winter. Six-foot snow banks and five-foot snow drifts made some deliveries almost impossible. Our oil dispatcher, mechanic and thirteen oil drivers worked extra hard to make sure our customers were able to stay warm.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          We want to shout out a big “THANK YOU!” to those customers who kept a path clear for our delivery men to access their fill pipes. As the overnight low temperatures went below zero, our phones rang off the hook with calls from customers who wanted deliveries. By giving us easy access to their delivery area, these thoughtful customers not only assured that they were able to stay warm, but saved our delivery team time, which allowed all of our customers to get oil.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The conditions were so difficult that we encountered new challenges in our delivery department. As a result, we employed several local high school football stars to climb the snow banks and pull the hose through the snow. These kids even shoveled out senior citizens and some who wintered in Florida. Once again we thank our customers, our staff and the kids by working with us throughout the crisis.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          There was a bright side, however, as there almost always is. Just as JFK used to claim “out of crisis comes opportunity”, the extreme cold weather forced us to think outside the box. I personally spent most of February driving an oil truck and trudging through the snow, sometimes with one of my sons, sometimes alone. I delivered oil on a lot of Saturdays and Sundays. This gave me the opportunity to see a lot of customers that I have not seen in years. It gave me the chance to thank them for being loyal customers. I would thank them for staying with us; they would thank us for working so hard and never letting them down. My son learned about hard work and how to treat your customer.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          We also got hundreds of phone calls and emails from customers of other companies who simply failed, neglected and even refused to deliver to their clients. Unlike Jamie Oil, their aging trucks would not start; their staff was not as committed or resourceful (some stayed home and called in sick) and their customers suffered because of it. Once again JOC guaranteed quality and delivered… and our customers were never at risk.
          &#xD;
      &lt;span&gt;&#xD;

      <title>Jamie Oil Beats Mayhem</title>

          We have all seen the television ads for the insurance company where the character called “Mayhem”, dressed in a black suit, white shirt and black tie, flies off of the back of a pickup truck or falls thirty feet causing extensive injury to himself, others and damage to their property. This past winter, Mayhem hit some heating oil dealers.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The winter of 2013 – 2014 has proven to be one of the harshest winters of the past twenty years. The snowfall totals were among the highest in years, and that combined with the subzero temperatures really took a toll on the heating oil business. Here at Jamie Oil, we paid our experienced employees overtime to work on the HESS plan, which stands for Holidays, Evenings, Saturdays and Sundays. We had nine oil trucks out on the road on New Year’s Day, as well as Saturday, January 4, the coldest day in MetroWest in over ten years.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          As far as service goes, not one of our customers went cold. We had ten licensed service technicians, with an average of twenty-seven years of experience each, on the road. They were able to rely on our two warehouses that are stocked with oil burner and service parts to better serve our customers and protect us and them against Mayhem.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          When we opened the office on New Year’s Day, Tony Borelli our General Manager, with over forty years of experience, arrived at 6:30 am to manage operations. When the temperature was minus nine over the weekend, we staffed the office with eight people to better service our customers. A safe four wheel drive SUV dubbed as “Tommy’s Taxi” picked up office staff during several snowstorms which insured our customers a voice on the phone during the crisis. Our Service Manager John Gallagher (with thirty-seven years experience) kept our trucks running and allowed us to do what we do best: guarantee our customers quality, especially when the going gets tough.
          &#xD;
      &lt;span&gt;&#xD;

      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

      <title>FDR and Something to Remember</title>

          To most people, the acronym FDR stands for Franklin Delano Roosevelt, the 34th President of the United States, who worked brilliantly with British Prime Minister Winston Churchill in an effort to save democracy and win World War II.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          At Jamie Oil, FDR means something entirely different. To us FDR stands for the three most important things we want to do when we service our customers every day. It is really pretty simple: We want to be Fair, Decent and Reasonable with all of our customers, employees and business partners one hundred percent of the time.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

          We understand that we DO NOT live in a perfect world. We understand that sometimes our customers pay two days late for an oil delivery and miss our prompt payment discount. We know that homeowner’s heating systems fail at the worst possible time, requiring an expensive repair, just when the real estate taxes are due or the day after the college tuition was paid. Our goal is to be responsive to our customer’s needs.       <title>Three Kinds of Heating Oil Companies</title>

          After you have been in the same business in the same area for over twenty years, you should be able to figure out just what is going on. While it seems as if a new company pops up selling heating oil just about every few months, all providers of retail home heating oil fall into three basic categories. It is really pretty simple….not all local energy retailers are the same.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The first category is the “one truck operator.” He has few if any employees, does not do any service or repair work on heating systems and most likely does not offer fixed price programs or any type of budget payment options for heating oil. They may be affiliated with a third party that does service and repair work on furnaces, but these independent operators (often another one man show) usually do not offer service policies, they do not inventory all of the parts necessary to provide quality service and they do not guarantee their work.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The one truck operator might deliver oil part time and offer aggressive prices because a low price is all he can offer. If you buy oil from this type of company and end up with a serious problem with your furnace, you could be stuck.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          On the other end of the scale is the “multi state operator.” These companies are the big guys. They actually deliver oil in other New England states. They tend to be deep in debt and their overhead is much higher than the local companies because of the huge payments they make to the bank each month on their massive loans. They usually charge their customers the highest prices, are poorly managed and very difficult to deal with from a customer’s point of view. Supervisors avoid customers, sitting behind big desks on computers like big shots. These companies don’t understand that our business is like being a plumber or a landscaper: crossing state lines to provide what is essentially a local service is expensive, inefficient and just does not work well for the consumer.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Then you have the local, full service companies. These companies limit their area of distribution to perhaps ten towns, they do most of their work in one county, within fifteen miles from their office. They are the low cost supplier of oil and heating service in the areas they cover. The company is run by the owner, who has a vested interest in making sure things are done right. They offer all the services customers want and the owner and local management guarantee quality. You can get an answer from a supervisor. They support local charities and the community itself.

    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

      <title>The Tale of Lester Greene</title>

          The year was 1982, my first in the oil business. I was working for Hess Oil at the time, supplying fuel oil to large industrial institutions in Connecticut. Among our larger customers were General Electric, Dow Chemical and Yale University.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          In the fall of ’82 I met a man named Lester Green. Lester was in his sixties and was very sharp. He was a wonderfully generous man who had talent, real estate and money. He owned a complex of apartment buildings in the northeast corner of the state. The seven or eight buildings had about thirty apartment units in each. They also had very large fuel storage tanks, which if filled in the summer, held enough oil to heat the buildings for the entire winter season.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The previous winter was our first with Lester as a customer. He bought over one hundred thousand gallons of heating oil, which Hess delivered in August. Lester was very happy that year. He got lucky. He bought the oil right. Shortly after writing the six figure check, the price of oil went up. Lester was so impressed with our company that he bought Hess stock and wrote to Leon Hess (who owned the New York Jets at the time), telling him just how pleased he was with his company. “Your men are like my own boys.” Lester wrote.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          The next winter was a different story. Lester filled his tanks again prior to the cold winter months. An international recession caused crude oil prices to fall from $32.00 per barrel to $28.00 by Thanksgiving. The warmest December on record caused wholesale heating oil prices to fall thirty percent in season, which never happened before. Lester could have saved over $30,000.00 if he did not fill his tanks in August.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Lester then called to complain. He insisted upon speaking with Mr. Hess. He called himself “the victim” and demanded “restitution” for his “losses”. According to Lester, we had “bamboozeled and schnookered” him. I’ll always remember what Lester said next: “This is a miserable situation!”
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          That year, my first in the business, I got to see the financial and emotional damage gambling on oil prices can cause. I made it my business to educate my customers on just how risky fixed price purchasing can be, soon after my encounter with Lester Green.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Sometimes you win, sometimes you lose, and some gamblers get wiped out. Lester did not get wiped out. He was just angry. I share Lester’s tale with you hoping that a better understanding of history will help you make better decisions.

      <title>What is Downside Protection?</title>

          Downside protection is an option Jamie Oil offers at an additional cost which ensures that your price per gallon will decrease should oil prices fall after you have locked in. If you choose to purchase downside protection when you sign a contract, and our daily posted price is less than the rate you locked in at on the day of your delivery, Jamie Oil will charge your account the lower rate.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          In July of 2008, oil prices reached a high of $4.799 per gallon, and continued to rise. Many customers feared paying over $5.00 a gallon, so they began to lock in at the $4.799 rate. As the winter approached and the cold weather settled in, prices began to fall. By December, our daily discounted rate dropped to $2.599 per gallon. Customers who locked in during the summer were now paying $2.20 more per gallon than the customers who decided not to lock in, and many customers that requested fixed price contracts wanted to break their contract and get out of the deal.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          As our practice has always been, Jamie Oil only offers fixed price contracts to those who request to lock in. We do not encourage or discourage our customers to sign a contract; it is your decision. We offer all of the options in the marketplace to our customers and we let you decide whether or not to lock in. And in every contract we send, there is the downside protection option which is our insurance program that lessens the financial impact to those who fear locking in at the wrong price.
         &#xD;
    &lt;/span&gt;&#xD;

      <title>How Fixed Price Programs Really Work</title>

          Every summer, Jamie Oil signs a limited number of contracts with our suppliers to purchase heating oil for the upcoming winter. We then add a markup that covers our overhead and notify our customers that fixed price programs are available. As our customers sign the contracts, we are careful to keep track of the number of gallons that we have sold as it is essential that we match our purchases with our sales of fixed price gallons. As more customers sign up, we purchase more fuel for next winter.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
           Most likely, the price we are paying has changed since our initial offering. We then adjust the prices of our programs accordingly. If we buy too much and the market falls, or if we oversell and the market goes up, we are at risk of incurring enormous financial losses. That is why we hedge our program by buying what we sell and selling what we buy. We offer

      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;strong&gt;&#xD;
      
          downside protection
         &#xD;
    &lt;/strong&gt;&#xD;

          – an insurance program that lessens the financial impact to those who fear locking in at the wrong price. A cap program is one that adds downside protection to a fixed price purchase. It is important to remember that no program guarantees the customer the lowest price in New England every day of the winter.

          While fixed price contracts have become more popular over the last fifteen years, they have not always been the best decision for the consumer. Many Massachusetts homeowners have complained to the Better Business Bureau and Attorney General’s Office after signing a contract and oil prices fell, only to find that the contracts hold up and defaulting on one will have an adverse impact on your credit rating.

It is an agreement. It is a contract, and parties (both oil dealers and consumers) that breach have been found liable and subject to fines in U.S. courts. Customers are obligated to accept delivery and pay for the oil they order in accordance with the terms of the contract.

          No, not always. It is very unrealistic to expect that your locked-in rate will always be lower than the daily rate every single day of your contract term.

          What Happens When The Contract Expires?

          Your account remains on automatic delivery until you request a change in your delivery status. After the locked-in rate has expired, we continue to deliver fuel to your house at our prevailing daily rate until another price agreement is signed.

  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

          What happens if I run out of fixed price gallons before the contract ends?
         &#xD;

          After we have delivered the quantity of fixed price gallons you ordered, your account will remain on automatic delivery, and oil deliveries will be charged at our prevailing daily rate until the contract ends. Our contract allows our customers the flexibility of choosing how many gallons they want to lock in, but requires the customer to be on automatic delivery until the end of the contract, even after the locked in gallons have all been delivered. If you wish to terminate automatic deliveries after the contract has expired, you need to do so in writing, or by e-mail.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;

          Last year, my neighbor had a lower lock-in rate than I had. Why?

          Prices change every day. It is common for prices to go up or down $ .08 – $ .10 in a half hour. A customer who calls in the afternoon may get quoted a different price than one who had called that same morning. The price on each program is different.

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

          Why should I consider a price program?
         &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;

          If you fear that prices will rise, and you cannot tolerate the risk of rising prices for heating oil next year, you should consider a program.
         &#xD;

    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

          What happens if I have a credit balance on my account when the contract expires?

          First of all, that is your money. You can request a refund, provided all of your service and oil bills have been paid. You may leave it on your account, and future deliveries will be charged against the credit balance at our daily rate until another contract is signed.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

          What does “the programs have limited availability” mean?
         &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          It means that at any time, without notice, Jamie Oil may modify, change or withdraw any or all of our fixed price programs that we offer. Once the contract is signed, however, we fully intend to honor our commitments to our customer. Just as a bank reserves the right to adjust the mortgage rates they offer, we can change the price, terms or availability of our fixed price programs. Oil prices often change more in half an hour than real estate values, interest rates, and the stock market move in one year. Iraq’s invasion of Kuwait in 1990 made the price of oil go up $ .30 per gallon in a matter of minutes. It is possible that the prices we offer on August 1st may not be available on September 10th to those who fail to sign and return the contract.
         &#xD;

          We post that money to your account as a deposit, and apply it to your first delivery made after March.

          What happens if oil prices fall during the term of the contract?
         &#xD;
    &lt;/strong&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Locked-in customers will continue to pay the rate that they agreed upon until the contract expires. That is what “locked-in” means. Customers who purchase Downside Protection will be entitled to some relief in some cases if prices fall to low enough levels.

          Every summer our customers wrestle with whether to lock in to a fixed price program, a capped price program or pay our daily market rate for oil deliveries next season.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
           ﻿
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
          Below please find ten things you should know prior to making your decision.
         &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           It is your decision. We neither encourage nor require any customer to lock in.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           Your decision involves risk and some of the risk is yours.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           Every year oil prices go up on some days and down on others.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           Do not expect to “pick the bottom” of the market.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           Our employees have no idea what oil prices are going to do next year.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           If you lock in and oil prices go up, you win. You save money.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           If you lock in and prices fall, you lose. Locking in could cost you money.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           We order oil from our suppliers when you lock in, as is required by law.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           We cannot get out of the contracts we sign with our suppliers, and we require our customer to fulfill their obligations to us.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
           If a customer chooses to lock in five years in a row, it is likely that the customer will lose money two out of the five years.
          &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
